Terms & Conditions

These terms govern your use of Zephyrine's services. Please read them carefully before engaging with us. By submitting an enquiry or proceeding with a service agreement, you acknowledge and accept these terms.

1. Definitions

In these terms, the following definitions apply:

  • "Zephyrine" / "We" / "Us" / "Our" refers to Zephyrine, operating from 26 Jalan Stesen Sentral, 50470 Kuala Lumpur, Malaysia.
  • "Client" / "You" refers to the individual or entity engaging Zephyrine's services.
  • "Service" refers to any of the three services offered: Property Viewing Coordination, Property Management Oversight, or Short-Stay Luxury Arrangement.
  • "Agreement" refers to the service agreement formed when a client proceeds with a service following written confirmation from both parties.
  • "Website" refers to Zephyrine's website at https://zephyils.live.

2. Acceptance of Terms

By submitting an enquiry, signing a service agreement, or proceeding with any of our services, you confirm that you are aged 18 or above and have the legal capacity to enter into a binding agreement. If you are engaging on behalf of a company or organisation, you confirm that you have the authority to bind that entity to these terms.

3. Service Description and Scope

Zephyrine offers three property-related services in Malaysia, primarily serving the Kuala Lumpur metropolitan area:

  • Property Viewing Coordination — Research, pre-screening, viewing scheduling, agent and landlord communication, property briefs, and post-viewing comparison summaries.
  • Property Management Oversight — Ongoing coordination of maintenance, building management liaison, monthly status reporting, and access to our service provider network. Provided on a monthly basis.
  • Short-Stay Luxury Arrangement — Sourcing, lease negotiation, move-in preparation, welcome package, and dedicated support for temporary furnished accommodation.

The precise scope of each service engagement will be confirmed in writing prior to commencement. Requests outside the agreed scope will be discussed and may attract additional fees.

4. Fees and Payment

Current service fees are as follows:

  • Property Viewing Coordination: RM 1,400 per engagement
  • Property Management Oversight: RM 4,800 per month
  • Short-Stay Luxury Arrangement: RM 7,650 per arrangement

All fees are quoted in Malaysian Ringgit (MYR) and are inclusive of GST where applicable. Payment terms, including deposit requirements and invoicing schedules, will be set out in the service agreement. We accept payment by bank transfer. Late payments may incur an administrative charge. Fees are subject to revision with reasonable notice.

5. Cancellation and Refund Policy

For Property Viewing Coordination: If you cancel before any viewings have been scheduled, a full refund will be considered upon written request. Once viewings have been arranged and confirmed with agents, a partial fee reflecting work completed will be retained.

For Property Management Oversight: Either party may terminate the arrangement with 30 days' written notice. Fees are not refunded for partial months where services have been delivered.

For Short-Stay Luxury Arrangement: Cancellation after lease negotiation has commenced may result in forfeiture of any deposit paid, depending on the stage of the process and any costs already incurred on your behalf.

6. Client Responsibilities

To allow us to deliver our services effectively, you agree to:

  • Provide accurate and complete information about your requirements and circumstances
  • Respond to communications in a reasonably timely manner
  • Not use our services for any unlawful purpose
  • Inform us promptly of any material changes to your situation that may affect the service
  • Treat our team and any third parties we facilitate contact with respectfully

7. Intellectual Property

All written materials, property briefs, comparison documents, reports, and other content produced by Zephyrine as part of a service engagement remain the intellectual property of Zephyrine. You are granted a personal, non-transferable licence to use these materials for the purposes of the engagement. You may not reproduce or distribute them commercially without our prior written consent.

8. Disclaimers

Zephyrine provides property advisory and coordination services. We do not provide legal advice, financial advice, or valuation services. Our assessments of properties reflect the professional opinion of our team at the time of assessment and should not be treated as formal surveys or valuations. We do not guarantee that properties will remain available, that lease terms will be agreed as anticipated, or that a property will perform in any particular way after tenancy commences. All recommendations are made in good faith based on the information available to us at the time.

9. Limitation of Liability

To the fullest extent permitted by Malaysian law, Zephyrine's liability for any loss or damage arising from the provision of services is limited to the fees paid for the specific service giving rise to the claim. We are not liable for indirect, consequential, or incidental losses, including lost profits or opportunity costs. Nothing in these terms limits our liability for fraud, gross negligence, or any liability that cannot be excluded under Malaysian law.

10. Indemnification

You agree to indemnify and hold harmless Zephyrine, its advisors, and staff from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these terms, your misuse of our services, or inaccurate information you have provided to us.

11. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information disclosed in the course of an engagement. This obligation survives the termination of the service agreement. Zephyrine will not share your personal details with third parties except as outlined in our Privacy Policy or as strictly necessary to deliver the service.

12. Termination

Either party may terminate a service agreement by providing written notice as specified for each service type (see Section 5). Zephyrine reserves the right to terminate an engagement immediately and without refund if a client behaves inappropriately toward our team, provides materially false information, or uses our services for unlawful purposes.

13. Governing Law and Dispute Resolution

These terms are governed by and construed in accordance with the laws of Malaysia. In the event of a dispute, both parties agree to first attempt resolution through direct discussion and good-faith negotiation. If a resolution cannot be reached, disputes will be subject to the exclusive jurisdiction of the courts of Malaysia, with the courts in Kuala Lumpur as the agreed venue.

14. General Provisions

These terms constitute the entire agreement between you and Zephyrine regarding use of our services and supersede any prior discussions or representations. If any provision is found to be unenforceable, the remaining provisions continue in full force. Failure to enforce any provision does not constitute a waiver. These terms may not be assigned by you without our prior written consent.

15. Changes to These Terms

We may revise these terms from time to time. Material changes will be communicated to active clients via email with reasonable notice before taking effect. Continued use of our services following notice of changes constitutes acceptance of the revised terms. The current version is always available on this page.
